  Notes	Jonas McCarty Will The state of Ohio Gallia County, vs: Be it remembered that at a court of Common Pleas within and for the said county of Gallia held at the courthouse in the town of Gallipolis on the twelfth day of June in the year of our lord one thousand eight hundred fifty-one before the Honorable William V Peck, Presiding Judge, Moses R Matthews, Franklin Carel And Robert Carter, Associate Judges The last Will and Testament of Jonas McCarty late of this county deceased was brought before the court and was proved by the oaths of Christopher Shuler and Charles W Matthews, the two subscribing witnesses thereto whose examinations were reduced to writing and it appearing to the court that the said Jonas McCarty at the time of Executing said will was of sound mind and memory and not under any restraint and was of full age. It is ordered that said will and the proof so reduced to writing be recorded and thereupon __________ personally came before the court and elected to take under the said will of her said husband. In the name of the benevolent father of all, I, Jonas McCarty, of Cheshire Township, Gallia Co, Ohio, do make and publish this my last will and testament. Item 1st I give and devise to my beloved wife in lieu of her dower, the farm on which we now reside, situate in the Township of Cheshire and state of Ohio, 61 acres of land No 411, 413, S7.13, town 5, Range 14, during her natural life and all its stock, household goods and chattles which may be thereon, at the time of my decease, during her natural life as aforesaid except the following property, to wit: one wagon, two horses and all the farming utensils on said farm, which I give and devise to my two sons Moses McCarty and Jonas McCarty Jr and their heirs forever. Item 2nd I devise and bequeath to my two sons Moses McCarty and Jonas McCarty Jr the farm on which Moses McCarty now resides, situate in Cheshire Township Gallia County Ohioi, fifty nine acres of land, No 401 in R14 Twon 5 and Sec 14. 3 also I devise and bequeath to my sons Moses McCarty and Jonas McCarty Jr the claim willed to me by father Jonas McCarty Seynur, now deceased and their heirs forever. 4 also I bequeath to my four daughters Nancy Swisher, Eliza Hacket, Rachel Coughenour, Esther Jane McCarty, each the sum of fifty dollars which is to be paid by my two sons one year after the death of my wife, Ten dollars of the money to Nancy Swisher is to be paid for tombstones and deducted from the fifty by my two sons Moses McCarty and Jonas McCarty. Also my two sons to pay my just debts and funeral expenses. I do hereby revoke all former wills by me made in testimony whereof I have hereunto set my hand and seat this 25 day of April in the year of our Lord 1851. The state of Ohio, Gallia County ___ I Charles W Mathews and C Shuler make oath taht they were the subscribing witnesses to the last will and testament of Jonas McCarty now deceased - that they subscribed the same in his presence at his request and as his last will and testament - that he was of sound mind and disposing memory at the time under no restraint & over twenty one years of age and that he is since dead. Their son Jonas Jr. was born here February 19, 1827 and married October 1, 1846 Sophfrona Jones born August 29, 1825 in Athens Co., Ohio, daughter of Elias and Charlotte (Smith) Jones. Elias born Essex Co., N.Y., died 1838. Charlotte born in Vt. died May 4, 1838 age 44. Jonas Sr. died 1851 and his wife died past 92 years of age. Jonas Jr. and wife had: Charlotte, Alonzo, Charles, Missouri, Cecelia and Serena.
