Jonas McCarty Will
The State of Ohio Gallia County, ss:
Be it remembered that at a Court of Common Pleas within and for the said county of Gallia held at the courthouse in the Town of Gallipolis on the twelfth day of November in the year of our Lord one thousand Eight Hundred forty nine, before the Honorable William V Peck, Resident Judge, Daniel G Whiton, Moses R Matthews & Franklin Carel, asociate Judges, the last Will and testament of Jonas McCarty, late of this county deceased was brought before the court and was proved by the oaths of Alexander Frazier and Jeremiah Shuler, two of the subscribing witnesses thereto, whose examinations were reduced to writing and it appearing to the satisfaction of the court that the said Jonas McCarty at the time of executing said will was of full age and of sound mind and memory and not under any restraint and that he is since deceased It is ordered that said will and the proof so reduced to writing be recorded and thereupon on motion of George McCarty the executor in said will named it is ordered that Letters Testamentary be granted to the said George McCarty who thereupon gave bond to the acceptance of the court with Benjamin McCarty and Peter Swisher his sureties in the penalty of two hundred dollars conditioned according to law.
Ordered that Peter Swisher, Peter Kanup, and Alexander Frazier after being duly sworn appraised the personal estate of the said deceased. And which said last will and testament and proof so reduced to writing are in the words and figures following, to wit:
In the name of God amen, I, Jonas McCarty of Gallia County in the state of Ohio being sick and weak of body but of sound mind memory and understanding considering the certainty of death and the uncertainty of the time thereof and being desirous to settle my worldly affairs and thereby be the better prepared to leave this world when it shall please God to call me hence do therefore make and publish this my last will and testament in the manner and form following that is to say
First and principally I commit my soul into the hands of Almighty God and my body to the Earth to be decently interred at the discretion of my executor hereinafter named and after my debts and funeral charges are paid and my wifes third taken out, I devise and bequeath as follows:
I give and bequeath to my sons George, Jonas, Benjamin, James and Silas the whole of my landed estate to be equally divided among them on the conditions hereinafter mentioned, but deducting from the shares of my sons George and Jonas the sum of twenty five dollars each they having previously received a fourth part of a hundred acres of land each from me, valued at twenty dollars each as their receipts will shew. The third of the land to remain in posision of my dear wife Catharine during the term of her natural life. Whereas the heirs of my son David, having highly offended me by their bad conduct, since the death of their Father, I do therefore hereby declare that the land given my son the said David and cost twenty five dollars as his receipt will prove shall go in full satisfaction of all right title interest claim and demand whatsoever which they may or can in any way pertain to have or claim in or to all or part of my real and personal estate. And whereas the only heir of my deceased son John has conducted himself in so unbecoming a manner in defiance of law and religion that I give and bequeath to him only the sum of one dollar to be paid him by my executor out of the value of my landed estate in full of all claim right or title in any real or personal estate belonging to me. I give and bequeath to my daughters respectively and to be paid out of the proceeds of the value of the land by my sons in equal portions in the following sums viz: I give and bequeath to my daughter Mary the sum of seventy five dollars. I give and bequeath to my daughter Eve the sum of fifty dollars, I give and bequeath to my daughters Rebecca, Elizabeth, and Sophia the sum of one hundred dollars each taken out of the valuation of the land. I give an bequeath in addition to the above hundred dollars to my daughter Sophy all my personal estate and which may remain after the demise of my dear wife Catharine. And lastly I do hereby constitute and appoint my son George to be my sole executor of this my last will and testament revoking and annulling all former wills by me heretofore made ratifying and confirming that and none other to be my last will and testament, In Testimony whereof I Jonas McCarty have to this my will set my hand and seal this sixth day of August in the year of our Lord one thousand eight hundred and forty four.

In the matter of the last will and testament of Jonas McCarty senior, Alexander Fraser and Jeremiah Shuler being duly sworn stated that they signed said last will and testament of said Jonas McCarty Senior as witnesses thereto and the said A Fraser says that at the request of the said testator he wrote said last will and testament at the _____ date, and that the said Alexander Fraser and J Shuler say that they heard said testator acknowledge said instrument for his last will and testament and saw him make his mark thereto and that they at his request signed the same in his presence and in the presence of each other as witnesses and that at the time of executing said last will and testament the said testator was of sound mind and memory under no restraint and over the age of twenty one years to wit, about the age of seventy seven and that he died on or about the 27th of October last past at the age of about eighty three and further they say not.
